There is a down home battle brewing in the blue grass state of Kentucky over the legality of gambling websites that are offering their services to the residents of Kentucky. I think that it is interesting to note that the governor of the state of Kentucky, Gov. Steve Beshear and his administration are actually proponents of legalizing casino gambling in their state. I suppose he sees this lawsuit as a way to get his agenda for legal casino gambling in his state to the forefront of the news. Perhaps the angle is by banning online gambling in his state he will be able to increase the potential value of bringing in casino gambling.
Here’s the problem with this lawsuit that Gov. Beshear has put before the courts of Kentucky. He has listed some 141 domains as being in violation and thus seizing those domains. Funny thing about this list is that it seems to be missing one of the bigger gambling domain names like TwinSpires witch happens to not only promote online poker but online horse race gambling. Did I mention that horse race gambling is already legal in Kentucky? Also another interesting fact about this particular site TwinSpires is that it is is actually licensed in Oregon, but owned by a small company you may have heard of called Churchill Downs Inc. out of Kentucky!!
I must say that this was a pretty ballsy move by Gov. Beshear to signal out over 140 domains but somehow leave out a few that actually have an interest in your state. The judge in the case is gathering all the information and hearing arguments from both sides which the gambling community has some 20 different lawyers from all over the place. Most of them arguing that the state of Kentucky has no jurisdiction and this lawsuit really has no basis for even being in the courts and the judge should throw the whole thing out. Last point I read on this is that the judge will be delivering his decision on Oct. 14th after further review of the facts.
I think this suit really has no business being in the courts at all. What business is it of the state to be able to dictate what websites people visit in the privacy of their own homes? I just don’t think the government has any right seizing control of a website especially when it’s obvious that it’s part of some political agenda that the governor has to further casino gambling in his own state. What a mess this has become and the further potential it has to be a bigger cluster F. depending on what the judge decides.
